Master Certified Indpendent Trustee

David has worked in the financial field since 1991. He first served as a professional trustee in 2007. He loves to help people develop and implement estate planning strategies that provide for their families and favorite charities. His professional credentials include:

Personal Financial Specialist
CERTIFIED FINANCIAL PLANNER(tm)

Master Certified Independent Trustee

David offers professional fiduciary services in four distinct areas:

#1: Consulting – Many people, especially those with significant assets and special circumstances, know that they should do estate planning, but often they do not know where to start. David helps clients explore how they can fulfill their legacies and address their situations. He calls this the “Who, What, When, and How” of estate planning. This service includes documenting the clients’ desired plans (for more efficient meetings with the attorney of their choosing). Upon request, David also recommends attorneys that he believes would be a good fit based on the clients’ needs and preferences.

#2: Acceptance – Very often, clients do not have someone they trust to adequately serve them as trustee or executor/personal representative. They might have a friend or family member who can be their power of attorney, healthcare surrogate/proxy, and/or agent for their living will/advanced directive, but these folks are usually not experienced with financial and legal matters. Frequently, clients simply want a neutral third-party. In other situations, there is an existing trust that needs a new trustee. David and his team can coordinate with Client’s attorney, review Client’s estate documents, assist with the re-titling of Client’s assets, and can accept the roles of trustee, successor trustee, and/or executor/personal representative.

#3: Administration – David utilizes a step-by-step process when providing estate and trust administration. Typical duties include:

1. Obtaining Death Certificates
2. Filing Original Will with Court
3. Hiring an Estate Attorney
4. Formally Accepting Fiduciary Roles
5. Obtaining EIN/Tax ID Number
6. Opening Estate/Trust Account

26. Distributing Personal Property
27. Disposing of Unwanted Assets
28. Preparing, Filing, and Paying Tax Returns

#4: Trustee – Many people who create trusts do not want all the money to be disbursed immediately after their death. They may also need their monies managed during a period of incapacity. As trustee, David can retain assets in the trust and provide ongoing oversight and administration. Responsibilities may begin during Client’s lifetime (due to Client’s incapacity, voluntary resignation, or when a Trust is created and funded for the benefit of others) or after Client’s death (if funds are to be held in a Trust and managed for beneficiaries). Typical trustee duties include:

1. Making Trust Assets Productive While Balancing Costs, Liquidity, and Flexibility
2. Hiring Service Providers (e.g., Investment Advisers, Realtors, and Attorneys)
3. Communicating with Trust Protector/Director and Other Parties as Appropriate
4. Coordinating with Client’s Healthcare Proxy/Surrogate for Care Needs
5. Making Distributions to Client or to Others on Their Behalf
6. Making Distributions to Beneficiaries or to Others on Their Behalf
7. Exercising Sound Judgment in Discretionary Distributions to Beneficiaries
8. Preparing and Filing Tax Returns; Ensuring Trust Taxes are Paid
9. Providing Tax Related Information to Beneficiaries
10. Sending Accounting and Financial Statements to Beneficiaries and Other Parties

When named as a trustee or executor, David’s CPA firm partner, Steve Tacinelli, is often named as his back-up in the clients’ trust and will.
